I. PRODUCTS and/or SERVICES

Terms of Offer. This Website offers for sale certain products (the "Products") and certain services (the "Services"). By placing an order for Products or Services through this Website, you agree to the terms set forth in this Agreement.

Products refers to any new or used item, article, or substance that is manufactured or refined for sale to customers by the business. 'ie: DVD, CD, USB Drive, Downloads, SD Card, Book, Other Merchandise.

Services refers to any action of helping or doing work for the customer by the business. 'ie: Digital Conversion, Storage, Processing, Handling, and Shipping.

Customer Satisfaction and Return Policy: Some of the products such as dvds, cds, games, and software sold by Small Digital Albums LLC may be previously used and may contain defects to the physical appearance but are promised to be in good working order. If you receive a media product that is not in good working condition, we do offer a return or replacement within 14 business days from the date the order was receipted.

(((Digital Media Conversion: "Not available in All Market Places".. At your option (when available) you can choose during checkout to have your order converted to a digital file format for inclusion on either a USB Drive or SD Card. This provides an additional quality check to the working condition of the product.

Digital Media Product file Types: When choosing to convert your media product to digital, we will use the most compatible file type currently available for playback on the majority of common audio/video devices. Though these file types may change based on industry standards, the current types we use are: MP4/OGG for most video products such as movies, tv shows, and music videos and MP3/OGG for most audio products such as music, songs, and audio books. PDF for digital books, magazines, and catalogues.


Original Unconverted Media Request: You may request your original media product be shipped to you at any time within 90 (ninety) days from date of sale via email request and by paying the difference in sale price, which would then be applied to the cost of processing and handling. If you do not request the original products in 90 (ninety) days from date of order, the original product will be permanently damaged to prevent unauthorized use of the product. Applicable Laws on the use of Digitally Converted Media:

1. The media file(s) are for personal and private use.

2. Due to unique platform offered by SMALL DIGITAL ALBUMS LLC, if you opt into digital conversion and have not requested the original product from us for delivery within 90 (ninety) days, you abandon all right to resell or transfer the Digital Files due applicable laws require you to possess the original product to accomplish the sale or transfer.)))  

Membership Opt In and Out: As the service becomes available, you May opt into or out of a membership of your choice at anytime time to receive or stop regularly scheduled delivery of media from us on either USB Drive, SD Card, Hard Drive or other method we may offer. Provisions for sale and return of any delivered products are the same as any of the other Terms and Conditions aforementioned.

Customer Solicitation: Unless you notify our third party call center reps or direct Small Digital Albums LLC sales reps, while they are calling you, of your desire to opt out from further direct company communications and solicitations, you are agreeing to continue to receive further emails and call solicitations by Small Digital Albums LLC and its designated in house or third party call team(s).  

Opt Out Procedure: We provide 3 easy ways to opt out of from future solicitations. 1. You may use the opt out link found in any email solicitation that you may receive. 2. You may also choose to opt out, via sending your email address to: support@smalldigitalalbums.com

Proprietary Rights. Small Digital Albums LLC has proprietary rights and trade secrets in the Products. Small Digital Albums LLC also has rights to all trademarks and trade dress and specific layouts of this webpage, including calls to action, text placement, images and other information.

Sales Tax. If you purchase any Products, you will be responsible for paying any applicable sales tax.

This Agreement will be governed by the laws of the State of COLORADO without regard to its conflict of law principles to the contrary. Neither you nor Small Digital Albums LLC will commence or prosecute any suit, proceeding or claim to enforce the provisions of this Agreement, to recover damages for breach of or default of this Agreement, or otherwise arising under or by reason of this Agreement, other than in courts located in State of COLORADO. By using this Website or ordering Products or Services, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding or claim arising under or by reason of this Agreement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.

Statute of Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Products or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Waiver of Class Action Rights.
